1. Confidential Beta Information
GroundPredict is an unreleased beta product. Product screens, workflows, features, prediction methods, confidence logic, reports, documentation, non-public pricing, roadmaps, and other non-public information provided through the beta are confidential information.
You agree not to share, publish, demonstrate, distribute, copy, or otherwise disclose confidential GroundPredict beta information except to people expressly authorized by GroundPredict.
2. No Copying or Competitive Use
You agree not to reverse engineer, reproduce, imitate, derive a competing product from, or use confidential GroundPredict beta information to develop or assist development of a competing subsurface intelligence product.
3. Field Validation Data
Ground-condition information you voluntarily submit may be stored, predictd, aggregated, and used by GroundPredict to validate and improve predictions, confidence methods, geological models, and future products.
GroundPredict will not intentionally present your company's private raw field submissions to other contractor users as identifiable contractor records unless separately authorized.
4. Beta Limitations
GroundPredict is a pre-bid planning and decision-support tool. It is not a site-specific geotechnical investigation, utility locate, engineering opinion, drilling plan, tooling recommendation, or guarantee of underground conditions.
Contractor responsibility and assumption of risk. GroundPredict predictions are provided only as supplemental information to assist the contractor's own evaluation and decision-making. The contractor remains solely responsible for verifying actual site and subsurface conditions, selecting appropriate drilling methods and tooling, determining bore paths and depths, preparing bids and pricing, and deciding whether and how to perform the work.
To the fullest extent permitted by applicable law, GroundPredict and its owners, affiliates, employees, and service providers are not responsible or liable for losses, costs, damages, or claims arising from reliance on a GroundPredict prediction, including damaged, stuck, lost, or destroyed downhole tooling or equipment; drilling or construction damage; delays or downtime; incorrect bids, estimates, pricing, or project costs; lost profits or revenue; or other direct, indirect, incidental, consequential, or economic losses. Users should independently verify conditions whenever actual subsurface conditions could materially affect safety, equipment, tooling, pricing, or project performance.
5. Beta Access
GroundPredict may approve, suspend, restrict, or terminate beta access. Access credentials are individual and should not be shared without authorization.
6. Agreement Record
Your typed name, account email, company, agreement version, user ID, and acceptance timestamp may be retained as part of GroundPredict's beta-access audit trail.
This beta agreement should be reviewed by qualified legal counsel before GroundPredict relies on it as a formal NDA with external contractors.
